In the Netherlands, mescaline is a List I substance under the Opium Act, but the cacti themselves (including peyote/Lophophora and San Pedro/Echinopsis) are not listed. As a result, unprocessed living cacti are generally legal to buy, sell, and possess; Dutch case law has held that the Opium Act prohibitions do not apply to the unprocessed cactus even though it naturally contains mescaline
